IVA is complicated and all of such cases hv to be andled by lawyers. i assume, every IVA application sumbitted will be assessed and filtered by the lawyer first.
The IVA successful rate from the ORO (Official Reciver office) is an independent and objective figure. e.g. 50%. that is to say, only 50 cases (asssed and submitted by a lawyer firm) will be successfull out of 100 applications.
currently, all of the lawyer firms always claim that the successful rate of their cases is high (>95%) and say that they will assess your cases first and will not accept your case if the estimated chance is not high. is it the true picture ? will they want to encourage their clients to apply for IVA and then make money ?
we can check to for some typical IVA cases from the http://legalref.judiciary.gov.hk/lrs/common/ju/judgment.jsp. There were some obvisouly not qualfified cases accepted and submitted by lawyer firm. fianally, it was dismissed by the judge in the 1st hearing before fowarding to creditor meeting. e.g. a case HBCI 1640/2004 was handled by a very famous lawyer firm.
